TERMS AND CONDITIONS OF USE FOR CUSTOMERS
AIPLAN Platform (www.aiplan.lat)
These Terms and Conditions (the “T&Cs”) regulate the access to and use of the AIPLAN technological platform, available at www.aiplan.lat and its associated channels (the “Platform”), by users seeking, booking, and/or purchasing tours, experiences, and tourism services (the “Tours” or “Services”) offered by independent tour operators (each, the “Operator”) authorized in Bolivia.
By accessing the Platform, creating an account, booking a Tour, or making a payment, you (the “Customer”) declare that you have read, understood, and accepted these T&Cs in their entirety. If you do not agree with any provision, you must not use the Platform or book Tours through it.
1. Who We Are and AIPLAN's Role
AIPLAN LLC (“AIPLAN”, “we”, “us”) is the owner and operator of the Platform, through which it promotes, markets, manages bookings, and processes payments for Tours offered by independent tour operators legally authorized to provide tourism services in Bolivia.
AIPLAN acts exclusively as a technological intermediary between the Customer and the Operator. AIPLAN is not the organizer, provider, owner, or reseller of the Tours; these are designed, organized, and executed entirely by the Operator under its own responsibility. The Platform serves as a channel for connection, booking, and payment collection.
Each Operator published on the Platform is an independent company, separate from AIPLAN, which holds its own licenses, permits, and authorizations to provide tourism services in Bolivia.
2. Eligibility and Account
To book a Tour, the Customer must be of legal age (or have the authorization of their legal representative) and provide true, complete, and updated information. The Customer is responsible for maintaining the confidentiality of their access credentials and for all activity carried out from their account.
3. Tour Information
The information, descriptions, itineraries, photographs, and other content of each Tour published on the Platform are provided by the respective Operator, who is solely responsible for their veracity, accuracy, and timeliness. AIPLAN does not guarantee the absolute accuracy of such information, without prejudice to the reasonable efforts it makes to verify it.
4. Bookings and Pricing
The Customer may book a Tour through the Platform by selecting the date, number of participants, and other available conditions. The price shown at the time of booking (the “Final Price”) includes the value of the Tour and the fees corresponding to the use of the Platform, and is expressed in United States Dollars (USD), unless another currency is indicated.
The Final Price may vary between different dates, seasons, or Tours. The price confirmed at the time of completing the booking is the one that is applicable and binding; prices displayed prior to confirmation are for reference only and may be updated.
The booking is understood to be confirmed once the Customer receives the payment and availability confirmation through the Platform or via email.
5. Payment
The Customer must pay 100% of the Final Price at the time of confirming the booking, using the payment methods enabled on the Platform. AIPLAN processes the payment in its capacity as a collection intermediary on behalf of the corresponding Operator.
The Customer is responsible for verifying that the payment details are correct and for ensuring sufficient funds and authorization for the transaction. AIPLAN may use third-party payment processing providers, whose terms and conditions shall also apply to the transaction.
6. Cancellation and Refund Policy

6.1 Half-day and full-day tours: The Customer may cancel their booking with a full refund up to 48 hours before the start of the Tour. Within 48 hours prior to the start, no refund of any kind will apply.

6.2 Multi-day tours: 75% of the amount paid is refundable if the Customer cancels 6 or more days in advance of the Tour's start date. The remaining 25% is non-refundable under any circumstances, as it covers logistical and accommodation costs committed since the booking confirmation. If the cancellation occurs within 6 days prior to the start, no refund will apply.

6.3 Customer No-show: If the Customer does not show up at the starting point of the Tour, or cannot start or complete it due to their own reasons (including flight delays or cancellations, illness, immigration or personal issues), no refund will apply, given that the service costs (staff, accommodation, logistics, among others) are already committed at the time of booking. The Customer is recommended to seek compensation through their travel insurance.

6.4 Force Majeure: In the event of force majeure events affecting the execution of the Tour (roadblocks, strikes, border closures, flight cancellations, extreme weather conditions, natural disasters, health emergencies, or other events beyond the reasonable control of the Parties), the following order of action will be followed:

(i) reasonable adaptation of the service, without the right to a refund;

(ii) if this is not possible, rescheduling or an alternative Tour of equivalent value; and
-
(iii) if no alternative is viable, a full refund for half-day and full-day tours, and a refund of up to 75% of the amount paid for multi-day tours, in accordance with clause 6.2.

6.6 Subjective Dissatisfaction: A refund will only proceed when the Service has not been provided or has been provided in a substantially different manner than contracted. Mere dissatisfaction, disagreement, or subjective assessment by the Customer regarding a Tour effectively provided in accordance with what was published (scenery, weather, food, accommodation, group composition, guide performance, or other aspects of personal appreciation) does not entitle the Customer to a refund, without prejudice to the inalienable rights recognized by consumer protection regulations and AIPLAN's discretionary authority to grant commercial compensation, without this implying an admission of liability.

6.7 Modifications Accepted by the Customer: If the Customer accepts in writing (including email or instant messaging) a modification or alternative to the service prior to its execution, such acceptance will be binding and will not give rise to a refund for differences between what was originally contracted and what was accepted, provided that the service delivered corresponds to what was accepted.
All approved refunds will be processed using the same payment method used by the Customer, within the reasonable timeframes required by the corresponding payment processor.
7. Operational Modifications and Safety Decisions
The Operator may, for operational, weather, or safety reasons, modify routes, schedules, itineraries, means of transport, or accommodations for others of equal or higher category, and suspend, shorten, or reschedule all or part of the Tour, without this constituting a breach, provided that the essential content and value of the Tour are preserved.
Decisions made in good faith by the Operator to preserve the safety, integrity, or health of the passengers—including the decision not to carry out, to interrupt, or to substantially alter a Tour—are presumed justified and will not be questioned regarding their timing or convenience, given that the Operator is the qualified professional present on the ground at the time of making such decision.
When a force majeure event generates additional third-party costs (alternative transfers, alternative border crossings, extra nights of accommodation, among others), the Customer may choose between accepting the modification by assuming the duly documented additional costs, or receiving a refund for the unused services in accordance with clause 6.4, deducting expenses already committed and non-recoverable.
8. Travel Insurance
AIPLAN expressly recommends that all Customers obtain travel insurance with medical, evacuation, and cancellation coverage before participating in any Tour. Coverage for the Customer's personal risks—including, without limitation, accidents, illness, medical evacuation, loss of baggage, and trip cancellation—shall be channeled through the travel insurance contracted by the Customer themselves. The Customer participates in the Tours under their own responsibility regarding such risks.
9. Altitude and Natural Conditions
Many of the Tours offered on the Platform take place in high-altitude areas, which can exceed 4,500 meters above sea level. The Customer is responsible for assessing their physical and medical fitness to participate, including any necessary prior medical consultation. Neither the Operator nor AIPLAN shall be liable for discomfort, illness, or consequences derived from altitude sickness (soroche) or pre-existing health conditions of the Customer, without prejudice to the Operator's duty to provide reasonable assistance.
If the Customer requests to shorten, interrupt, or modify the Tour by their own decision or for personal or health reasons, no refund will apply for unused services, as the corresponding costs are already committed.
10. Liability
The Tours are organized, coordinated, and executed by the Operator, who is solely responsible for their provision, as well as for the conduct of its staff, guides, drivers, contractors, and suppliers. The Operator declares that it maintains valid licenses and authorizations in accordance with the applicable Bolivian regulations for its activity.
AIPLAN does not organize, execute, or supervise the Tours, and does not guarantee their quality, suitability, safety, availability, or effective execution, this being the exclusive responsibility of the Operator. AIPLAN's liability is limited to its role in technological intermediation, promotion, booking management, and payment processing through the Platform.
Neither the Operator nor AIPLAN shall be liable for:

(a) events exclusively attributable to the conduct, negligence, or decisions of the Customer, including non-compliance with safety instructions;

(b) loss, theft, or damage to personal items under the custody of the Customer;

(c) pre-existing health conditions or altitude sickness, in accordance with clause 9;

(d) acts of third parties unrelated to the operation of the Tour;

(e) force majeure events in accordance with clause 6.4; and
-
(f) risks inherent to the nature of the activity, duly informed to and accepted by the Customer.
The foregoing is understood without prejudice to the inalienable rights recognized to the Customer by Bolivian consumer protection regulations, which are not limited by these T&Cs.
11. Claims and Complaints
Any claim related to a Tour must be channeled through the Platform's contact methods. AIPLAN will forward the claim to the corresponding Operator and will carry out an assessment based on the available evidence (communications with the Customer, vouchers, itineraries, photographs, reports, among others), communicating a response to the Customer within a reasonable timeframe.
If the Customer accepted a modification or alternative of the service in writing prior to its execution in accordance with clause 6.7, such acceptance will be considered in the assessment of the claim.
12. Chargebacks and Payment Disputes
In the event of any issue with a booking, the Customer is recommended to first contact AIPLAN through the Platform's channels before initiating a chargeback with their bank or card issuer, in order to manage a direct and more agile solution. AIPLAN may present the evidence corresponding to the transaction and the applicable cancellation policy to the payment processor.
13. Customer Conduct
The Customer agrees to use the Platform in good faith, provide true information, respect the safety instructions given by the Operator during the Tour, and refrain from any fraudulent, abusive, or unlawful use.
14. Reviews and User-Generated Content
The Customer may publish reviews, ratings, comments, and photographs about the Tours through the Platform. By doing so, the Customer grants AIPLAN a non-exclusive license to use, reproduce, and display such content on the Platform and its promotional channels. The Customer declares that such content is of their own authorship or that they possess the necessary rights to share it, and agrees not to publish defamatory, false, offensive content, or content that infringes upon the rights of third parties.
15. Personal Data Protection
AIPLAN treats the Customer's personal data in accordance with applicable regulations and the constitutional right to data protection (habeas data), solely for the purposes of booking management, payment, and communication with the Customer. The Customer's data necessary for the provision of the Tour will be shared with the corresponding Operator, who must use it exclusively for that purpose, refraining from using it for its own marketing purposes or commercializing it.
16. Intellectual Property
The Platform, its design, trademarks, logos, and proprietary content are owned by AIPLAN. Their reproduction, distribution, or unauthorized use is prohibited.
17. Amendments to these T&Cs
AIPLAN may modify these T&Cs at any time by publishing the updated version on the Platform. The modifications will not affect bookings already confirmed prior to their entry into force. Continued use of the Platform following the publication of modifications implies their acceptance.
18. Severability
If any provision of these T&Cs is declared null, invalid, or unenforceable, the remaining provisions shall retain full validity.
19. Governing Law and Jurisdiction
These T&Cs are governed by the laws of the Plurinational State of Bolivia. Any controversy shall first be resolved through direct negotiation in good faith between the Customer and AIPLAN through the Platform's contact channels. The foregoing is understood without prejudice to the rights and avenues recognized to the Customer by Bolivian consumer protection regulations.
